About Employment Discrimination and the Delaware Department of Labor

The Office of Discrimination enforces laws against employment discrimination because of race, color, religion, sex (including pregnancy), sexual orientation, national origin, disability, age (40 or older), marital status or genetic information.

Sexual orientation is a recent addition to the protected classes. By law, sexual orientation "exclusively means heterosexuality, homosexuality, or bisexuality."

These laws can be found in 19 Delaware Code Chapter 7. Other laws may protect you from other types of discrimination, such as discrimination in public accommodation or housing. These laws are enforced by the Delaware Human Relations Commission, http://www.state.de.us/sos/hr/.

The laws enforced by the Office of Discrimination protect you against employment discrimination when it involves:
  • Unfair treatment because of your race, color, religion, sex (including pregnancy), sexual orientation, national origin, disability, age (40 or older), marital status or genetic information.
  • Harassment by managers, co-workers, or others in your workplace, because of your race, color, religion, sex (including pregnancy), sexual orientation, national origin, disability, age (40 or older), marital status or genetic information.
  • Denial of a reasonable workplace change that you need because of your religious beliefs or disability.
  • Retaliation because you complained about job discrimination, or assisted with a job discrimination investigation or lawsuit.
