Job Order

Job Orders is the posting of jobs in the area of intended employment on an internet system. The Foreign Labor Certification programs require employers to post a job with the State Department of Labor. The State Department of Labor (DOL)/State Workforce Agency (SWA) will post this job request on the Delaware Joblink (DJL).

Once the FLC Unit has received the job order form, the form will be reviewed and processed with all pertinent information by the SWA. This form will be the proof of posting and it will be sent back to the requestor. A deficiency/correction letter will be sent out if any corrections need to be made.

Contact local union(s) where employer is a party to a collective bargaining agreement.

To view and print any job order, visit the Delaware Job Link (DJL).

Instruction in retrieving the job order is stated below:

  1. Go to website - http://joblink.delaware.gov
  2. On the right hand side of the page. Look under Quick Search
  3. Type Keyword and Click on Locations
  4. Click on Job
OR Register then Search Job Order by Job Order Number


PERM & H-1B Programs

To post a job order for the above programs, go to Job Order Formpdf icon, fill out, print, and submit by email. Once the SWA/FLC has received the form, it will be processed with all pertinent information by the SWA and form will be the proof of posting. All items on the forms need to be completed clearly. Retain the document for your records. Lawyer/Agent should not be the contact person because this is a conflict of interest.


H-2B Program

One of the pre-filing recruitment activities is to post a job order in connection with a future H-2B application. To request a H-2B job order formpdf icon, for a H-2B job order to be posted. All items on the forms need to be completed clearly. Retain the document for your records. Lawyer/Agent should not be the contact person because this is a conflict of interest. Minimum job order content requirements:

Indication the job is "temporary"

Total number of job openings

A statement that overtime work will be available (if applicable)

A statement that on-the-job training will be provided by the employer (if applicable)

A statement that transportation will be provided by the employer (if applicable)
Employer's name

Geographic area(s) of employment with specificity to apprise US workers of any travel requirements

Description of job opportunity with particularity

Expected start and end dates of employment

Work hours and days

Minimum education and/or experience requirements

Wage offer or range of applicable wage offers

The job order period will not be less than 10 days and should be placed no more than 120 days before the date of need.

All applicants referred by the SWA will be verified through the I-9 employment verificationpdf icon process. Employment Verification is the verifying of identity and employment eligibility, this was established by INA § 274A (b). Employer will receive documentation certifying the verification of any referrals that were referred by the SWA. All records will be kept at the SWA. Those verified referrals will be sent to the employer to be interviewed. Chicago NPC will be notified and sent this information.
